This policy explains how personal information collected through this website is handled, in line with the Protection of Personal Information Act, 2013 (POPIA). By using this site or submitting a form, you agree to the practices described here.
1. Who is responsible for your information
Quay 1 International Realty is the responsible party for personal information collected through this site, which markets the Luna development. Information may be shared with the developer of Luna for the purpose of the sale.
2. What we collect
Information you give us: your name, surname, email address, telephone number, and the buying details you choose to provide, such as budget range, deposit, whether you are buying cash or with a bond, your reason for enquiring, and whether you would like an agent to contact you.
Information collected automatically: standard technical data such as IP address, browser and device type, pages viewed, and referring page, gathered through cookies and similar technologies.
3. Why we use it
To send you the material you requested (such as the price list), to respond to your enquiry, to have an agent contact you where you have asked for that, to keep you updated about this development and the launch, to improve the website, and to meet legal or regulatory obligations, including those under the Financial Intelligence Centre Act and the Property Practitioners Act.
4. On what basis we process it
We process your information on the basis of your consent, given when you submit a form; to take steps at your request before entering into a possible agreement; and, where relevant, for our legitimate interests in marketing property to people who have asked to hear from us. You may withdraw consent at any time (see clause 6).
5. Who we share it with
The developer and the appointed sales agents for Luna; service providers who help us operate the site and communicate with you, such as hosting, content management, email delivery and analytics providers, who may only use it on our instructions; bond originators or finance partners, but only where you ask to be referred; and any party we are required to disclose to by law.
We do not sell your personal information.
6. Marketing and opting out
If you have asked for information about this development, we may contact you about it and about comparable opportunities. Every marketing message includes a way to opt out, and you can unsubscribe or withdraw consent at any time by contacting matthew.blow@quay1.co.za. Opting out of marketing does not affect messages we must send about a transaction you have entered into.
7. Cookies and analytics
This site uses cookies and similar technologies to make it work, to remember your choices, and to understand how the site is used so we can improve it. You can block or delete cookies in your browser settings, though parts of the site may then not work as intended.
8. How long we keep it
We keep your information for as long as needed for the purposes above, and thereafter only for as long as the law requires us to, or as long as it may be needed to establish or defend a legal claim. When it is no longer needed it is deleted or de-identified.
9. Security
We take reasonable technical and organisational steps to protect personal information against loss, unauthorised access and misuse. No website or transmission over the internet can be guaranteed to be completely secure, so any information you send is at your own risk.
10. Sending information outside South Africa
Some of our service providers host or process information outside South Africa. Where that happens, we take reasonable steps to ensure the recipient is subject to laws, binding rules or contractual terms that provide protection substantially similar to POPIA.
11. Your rights
You have the right to ask what personal information we hold about you, to have it corrected or deleted, to object to processing, to withdraw consent, and to lodge a complaint. To exercise any of these, contact matthew.blow@quay1.co.za.
